    This position will report directly to a CALID Senior Business Manager, and will proactively operate as a business partner for all relevant Third Party Agent (“TPA”) functions for Bruker CALID Group in CHINA in close collaboration with the CALID Legal & Compliance team.


    This position will assist in all of the commercial, legal and compliance matters of CALID Group in CHINA including but not limited to managing all kind of TPA contacts that arise from the day-to-day operation, providing advice and support primarily to the CHINA Commercial Team and operation of CALID Business, working on compliance matters in relation to operation of CALID Business. Place of employment is in Beijing.


    The objective of this role is to provide support to the CALID Group in CHINA by managing the CHINA TPA network in compliance with relevant laws and regulations and internal guidelines and processes.


    • The CALID Senior Channel & TPA Manager, China is responsible for providing independent oversight of the commercial & sales activities involving TPAs in China and will provide objective support to the various business initiatives within the company for all CALID divisions. This position will also be responsible for improving internal controls are followed, for improving internal controls and developing processes over tenders and will have decision rights over the selection of the TPA appointment to ensure compliance and transparency in the sales cycle.
    • Reports directly to a CALID Senior Business Manager and works collaboratively with the Divisional TPA Managers and business leaders, the Bruker TPA Compliance Manager-China, and the global TPA Compliance Management organization.
    • Supports the pre-selection of TPAs proposed by sales or TPA Manager.
    • Establishes and enforces policies and procedures over commercial deals in China, evaluates the need for a TPA, has final decision rights as to what TPA will be used, and whether or not a deal is approved on acceptable commercial (e.g margin)  or tendering terms.
    • Provides best practices to management and sales teams, and acts as an advocate and champion of compliance within the company to promote awareness and understanding of Bruker's TPA related compliance program and consequences of noncompliance.
    • Ensures that an effective internal controls system exists around tenders and TPA selection/management, and communicates these requirements and provides guidance to the sales team.
    • Evaluates and tracks outstanding sales cases involving TPA's and documents local items listed in the tenders.
    • The Senior Channel & TPA Manager is expected to verify the TPA account from Sales team on capability of the TPA including experience, staffing, resources and existing channel.  TPA Dealer Manager is also expected to conduct face-to-face interview to verify whether the TPA does nothave any office, resources, etc.
    • The Senior Channel & TPA Manager is also expected to manage the forecast of tenders and sales cases from the TPA.  This is to avoid those last minute tender requests where Bruker might end up  having little or incomplete disclosure on a tender.
    • Providing timely, pro-active and practical commercial advisory on various TPA issues that arise from the day-to-day operation in China.
    • The Senior Channel & TPA Manager should independently verify the calculation of costs of TPA and their margins.
    • Working closely with the CALID Legal and Compliance Department in Germany to ensure consistency in implementing global policies within the region.
    • Annual Review: Effectiveness of a TPA in distribution of Bruker products is also to be evalulated by China Dealer Manager.
    • Off boarding: When a TPA is terminated and removed from Bruker's TPA list, or a TPA is blacklisted, China Dealer Manager is expected to work with CALID Legal team on termination process.
    • Market conduct supervision: Support sales channel management.
    • Providing TPA related trainings as required by CALID Businesses in China.
    • Conducting gap analysis to improve exisiting processes to increase operational efficiency.
    • Other assignments and duties assigned by CALID Group Legal and Compliance.


    • At least 5 years' experience in multi-national company.
    • A Bachelor degree or higher degree in science / engineering / business administration / legal or comparable from a reputable university.
    • Excellent communication skills in both English and Chinese (written and verbal) with good cultural sensitivity.  Business fluency in Japanese would be highly desirable.
    • Good understanding of contract and commercial laws, anti-bribery laws and practice.
    • Familiarity or experience in life science and medical devices industry would be desirable.
    • Ability to travel in China.
    • High integrity and a good team player.
